Introduction and Terms
Welcome to Sessionably. These Terms of Use ("Terms") govern your access to and use of the Sessionably platform, including our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms.
Eligibility Requirements
To use the Sessionably platform, you must:
- Be at least 18 years of age
- Be a licensed mental health professional or authorized staff member of a mental health practice
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
HIPAA Compliance
Sessionably is committed to maintaining HIPAA compliance. As a Business Associate, we:
- Implement administrative, physical, and technical safeguards to protect PHI
- Encrypt all data in transit and at rest
- Maintain comprehensive audit logs
- Provide Business Associate Agreements (BAA) to covered entities
- Train our staff on HIPAA requirements
- Report any security incidents promptly
Account Terms and Data
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Create a strong, unique password
- Not share your login credentials with others
- Notify us immediately of any unauthorized access
- Log out of your account after each session
- Keep your account information accurate and up to date
You retain ownership of all data you input into the platform. We will not access, use, or share your data except as necessary to provide the Service or as required by law.
Client Facing Terms of Use Agreement
Purpose of Service
The Sessionably Client Portal provides clients of mental health practices with secure access to:
- Complete and sign intake documents and clinical forms
- View and download completed documents
- Access appointment information
- Communicate securely with their provider
- View and pay invoices
Eligibility and Access
Access to the Client Portal is provided by your mental health provider. To use the Client Portal, you must:
- Be an active client of a Sessionably-using practice
- Have received login credentials from your provider
- Be at least 18 years of age, or have parental/guardian consent
- Agree to these Terms of Use
Privacy and Confidentiality Standards
Your privacy is protected by federal and state laws, including HIPAA. We maintain strict confidentiality standards:
- Your health information is encrypted and stored securely
- Access to your records is limited to authorized personnel
- We do not sell or share your information with third parties for marketing
- You have the right to access and request copies of your records
- Your provider maintains control over your clinical information
User Responsibilities
As a Client Portal user, you agree to:
- Provide accurate and truthful information on all forms
- Keep your login credentials confidential
- Use the portal only for its intended purpose
- Not attempt to access other users' information
- Report any security concerns to your provider immediately
- Understand that the portal is not for emergency communications
Acceptable Use Guidelines
You agree NOT to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Transmit viruses, malware, or other harmful code
- Impersonate another person or entity
- Use automated systems to access the Service without permission
- Reverse engineer or attempt to extract source code
Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the fees paid in the preceding 12 months
- We are not responsible for the clinical decisions of healthcare providers
- We do not guarantee uninterrupted or error-free service
Data Privacy and HIPAA Notice
Your use of the Service is also governed by our Privacy Policy and HIPAA Notice of Privacy Practices. These documents explain:
- What information we collect and why
- How we protect your information
- Your rights regarding your health information
- How to file a complaint if you believe your rights have been violated
Modifications
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date
- Sending email notification for significant changes
Your continued use of the Service after changes constitutes acceptance of the modified Terms.
